Pixie Dust Entertainment Terms and Conditions

These Terms and Conditions form the basis of the agreement between you (the “Client”) and Pixie Dust Entertainment (“us,” “we,” or “the Company”) for the provision of entertainment services, including character parties, door knock visits, and personalised video messages. By booking with us, you confirm that you have read, understood, and agreed to the following terms.

‍1. Definitions

1.1. Client:

The individual or entity booking services from Pixie Dust Entertainment.

1.2. Performer(s):

The individual(s) provided by Pixie Dust Entertainment to deliver the booked service.
‍
1.3. Services:

The entertainment services provided, including but not limited to character parties, door knock visits, and personalised video calls.
‍
1.4. Booking Confirmation:

The email or written confirmation from Pixie Dust Entertainment that secures your booking.
‍
1.5. Event Location:

The address provided by the Client where the Services will take place.
‍
1.6. Fee:

The total amount payable for the Services.

‍2. Booking Process

2.1. All bookings must be made via email, phone, or our online booking form. A booking is not confirmed until you receive a Booking Confirmation from Pixie Dust Entertainment.

2.2. Upon confirmation, you must review the details of your Booking Confirmation to ensure accuracy. Any discrepancies must be reported within 24 hours.
‍
2.3. Pixie Dust Entertainment reserves the right to decline any booking request at our discretion.

‍3. Payment Terms

3.1. A non-refundable deposit of 50% of the total Fee is required to secure the booking.
‍
3.2. The remaining balance must be paid in full no later than 48 hours before the event. For door knock visits and video calls, full payment is required at the time of booking.
‍
3.3. Payment can be made via bank transfer made to the account listed on your invoice.
‍
3.4. Failure to pay the remaining balance by the due date may result in cancellation of your booking without refund of the deposit.

‍4. Cancellation Policy

4.1. Client Cancellations:

If you cancel your event after securing it but before paying the remaining balance, you are not entitled to any refund. If you cancel your event after paying your remaining balance, you will be entitled to a 50% refund, excluding your non-refundable deposit. Cancellations within 48 hours of the event will not be refunded. Cancellations of door knock visits and video messages are non-refundable.

4.2. Company Cancellations:

In the unlikely event that Pixie Dust Entertainment cancels your booking due to unforeseen circumstances, we will provide a full refund, including the deposit, or offer a reschedule at no additional cost.

4.3. Pixie Dust Entertainment is not responsible for cancellations caused by events outside our control, such as severe weather, venue issues, or other force majeure events.

‍5. Event Details

5.1. Event Location:

The Client is responsible for providing an accurate and safe Event Location address. Parking arrangements must be made available for the Performer(s) as close to the venue as possible.

5.2. Event Timing:

The Client must adhere to the agreed start and end times for the event. If the event is delayed due to the Client or attendees, Pixie Dust Entertainment is not obligated to extend the duration of the service.

5.3. Space Requirements:

The Client must ensure a safe and adequate space for activities, including a designated changing area for the Performer(s) if required.
‍
5.4. Number of Children:

The maximum number of children allowed per booking will be specified in your Booking Confirmation. If the number of children exceeds this, additional fees may apply, or the Performer(s) may be unable to perform certain activities for safety reasons.

‍6. Services

6.1. Character Performances:

Performers remain in character throughout the event and adhere to the activity plan agreed upon at the time of booking. Performers cannot supervise children; an appropriate number of adult chaperones must be present at all times.

6.2. Door Knock Visits:

These visits are designed to be short, surprise appearances and may include a song, gift delivery, or quick interaction as specified in the Booking Confirmation. The Client must ensure timely access to the property for the Performer.

6.3. Personalised Video Messages:

Video messages will be delivered to the client no more than 72 hours after receipt of payment. In the case of unforeseen circumstances, Pixie Dust Entertainment reserves the right to extend this deadline.

‍7. Health and Safety

7.1. Pixie Dust Entertainment prioritises the safety of all attendees and Performer(s). The Client must disclose any relevant health or safety information at the time of booking.

7.2. The Client must ensure that the Event Location is safe and free from hazards, including adequate lighting, space, and shelter from inclement weather.
‍
7.3. Performer(s) reserve the right to discontinue activities or leave the event if they feel their safety or the safety of others is at risk. This includes but is not limited to extreme weather, disruptive behaviour or breach of contract by the Client.

7.4. Pixie Dust Entertainment is not liable for injuries or accidents occurring at the event unless caused by negligence on the part of the Performer(s).

‍8. Equipment and Costumes

8.1. Performer(s) will bring all equipment necessary for the agreed activities. Clients must ensure equipment is used only by the Performer(s).

8.2. Any damage to costumes or equipment caused by the Client or attendees will be charged to the Client.

‍9. Content and Media

9.1. Performer(s) may request permission to take photographs or videos during the event for marketing purposes. The Client may decline this request and no service will be withheld based on this decision.

9.2. Personalised video messages are intended for private use and may not be distributed or shared publicly without the consent of Pixie Dust Entertainment.

9.3 Any photos taken by the Client or Attendees and subsequently posted on social media or sent to Pixie Dust Entertainment may be used for marketing purposes. The client agrees to only forward or share photographs or videos of children where explicit consent has been given by the parent/guardian. Pixie Dust Entertainment accepts no responsibility for any media shared with us and subsequently used for marketing purposes where consent has not been obtained.

9.4 Pixie Dust Entertainment complies with applicable data protection laws, including GDPR. Personal information will only be used for the purpose of providing services and will not be shared without consent.

‍10. Liability

10.1. Pixie Dust Entertainment holds Public Liability Insurance to cover claims arising from negligence on our part. Proof of insurance can be provided upon request.

10.2. Pixie Dust Entertainment is not liable for: Loss or damage to personal property. Injury or accidents resulting from unsupervised children. Delays or cancellations caused by circumstances beyond our control.

‍11. Code of Conduct

11.1. The Client agrees to treat Performer(s) with respect and professionalism. Abuse, harassment, or inappropriate behaviour will not be tolerated and will result in the immediate termination of services without refund.

11.2. All entertainment provided is family friendly. Performer(s) will not engage in content or activities deemed inappropriate or outside of the scope of the booking.

‍12. Complaints and Disputes

12.1. If you are dissatisfied with any aspect of the service, please contact us in writing within 48 hours of the event.

12.2. Pixie Dust Entertainment will investigate all complaints promptly and aim to resolve disputes amicably.

‍13. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

‍14. Amendments

Pixie Dust Entertainment reserves the right to amend these Terms and Conditions at any time. Updated terms will be provided to Clients.
